Description

Rauland Grube appealed from the denial of his application for post-conviction relief regarding his first-degree murder conviction in the 1983 death of Amy Hossner in Ashton, Idaho. Grube argued that the state violated his due process rights by failing to disclose evidence in its possession prior to trial, consisting of a recorded interview with a witness, Lynn Gifford, who was never called to testify at trial but who had provided exculpatory and impeaching evidence favorable to Grube. Grube claimed that the constitutional violation and the existence of material facts, not previously presented and heard, entitled him to vacation of his conviction and sentence and a new trial.
